The Fake Sale Deed Fraud: How It Happens and How to Detect It

Fraudsters can 'sell' your property without you knowing. Here's the exact mechanism, real cases, and how to catch it before it costs you everything.

How Can Someone Sell Your Property Without You?

It sounds impossible, but fake sale deed fraud is one of the most common property crimes in India. The mechanism exploits gaps in the physical verification system at sub-registrar offices.

The Mechanism

  1. Obtain a forged POA: Using forged Aadhaar and signature, create a Power of Attorney document that appears to authorize a third party.
  1. Find a willing buyer: Sell the property at a below-market price to a buyer who may be knowingly or unknowingly participating.
  1. Register the deed: Present the forged POA at the Sub-Registrar. Some offices have inadequate verification. The deed gets registered.

4. Possession transfer: The "buyer" starts construction or fencing to establish possession.

5. Discovery (too late): The real owner discovers this when they visit the plot or try to sell it themselves.

Red Flags in EC

The earliest you can catch this is through a regular EC check. Any new transaction — sale, gift, or partition — will appear. If you didn't authorise it, it's fraud.

What To Do Immediately

  • Do NOT confront the occupants alone
  • Preserve the EC evidence
  • File an FIR for forgery, fraud, and cheating (IPC 420, 467, 468)
  • File a civil suit for cancellation of the fraudulent deed
  • Apply for a stay order from the civil court

Speed matters enormously. Courts look much more favorably on complainants who act quickly.
